Terms and Conditions of Use
Last updated: 8 October 2026
AUTOMATIC RENEWAL NOTICE
SPARK subscriptions renew automatically. Read these Terms and Conditions (the “Terms”) before you start a free trial or buy a plan. To avoid being charged, cancel at least 24 hours before your trial or current billing period ends. If you don’t cancel in time, the subscription renews and you are charged.
Deleting the app does not cancel your subscription or trial. App Store refunds are handled by Apple. Web‑purchase refunds are covered by our Money‑Back Policy. How we handle your data is explained in our Privacy Policy.
DISPUTE RESOLUTION NOTICE
Section 13 requires most disputes between you and us to go through binding individual arbitration instead of court, and waives class actions and jury trials, unless you opt out as described in Section 14. This doesn’t apply to residents of the EEA or UK (see Section 15).
1. ACCEPTANCE OF TERMS
These Terms are an agreement between you and Limited Liability Company “DEXTONS” (LLC “DEXTONS”), a company incorporated under the laws of Ukraine, registered office at 2B Pavla Li Lane, premises 8, Holosiivskyi District, Kyiv, 03195, Ukraine (USREOU code 45985709) (“Company”, “we”, “us”), for your use of the SPARK mobile app, the SPARK keyboard extension, our website and related services (the “Service”), including all text, articles, trainers, graphics and software in it (the “Content”).
By using any part of the Service, you agree to these Terms. If you don’t agree, stop using the Service, delete your account and cancel any active subscription. The English version of these Terms prevails over any translation.
Other documents. Our Privacy Policy and Money‑Back Policy are part of these Terms. We may add feature‑specific rules in the app; they also apply.
Changes. We may update these Terms when we change features, for legal reasons or in unforeseen circumstances. We’ll update the date below and, where the law requires or the change is material, notify you in the app or by email. Continuing to use the Service after changes take effect means you accept them.
Changes to the Service. We may add, change, suspend or remove features at any time. Some features may not be available in every country, language or operating system version.
2. WHAT SPARK IS
SPARK is an AI communication coach for dating and social conversations. It lets you:
- Get reply suggestions for messages, conversations and chat screenshots you provide — in the app or with the SPARK keyboard;
- Check a match (Match Score) using a profile screenshot, and get opener ideas;
- Improve your profile — a profile score, photo ranking (Photo Lab), bio rewrites and an improvement plan. SPARK doesn’t generate or edit photos;
- Train your skills (Learn) — a baseline test, a 5‑day plan, AI trainers and quizzes (text, choice, timer and voice formats), real‑life tasks, articles and a Communication Score across Confidence, Empathy, Humor, Initiative and Boundaries.
SPARK is an independent product. It is not affiliated with or endorsed by any dating app or social network, and it doesn’t log into, post to or automate your accounts on them. You use those platforms under their own terms.
3. ACCOUNT
Age. The Service is only for people aged 18 or older who can enter a binding contract. If you’re under 18, you may not use it.
Registration. You sign in with Apple or Google, or activate a web purchase with your personal code. Information you give us must be accurate. One account per person.
Security. You’re responsible for your device, sign‑in and personal code, and for all activity under your account. Tell us at [email protected] or via our contact form at puredating.club right away if you suspect unauthorised access. We aren’t liable for losses caused by your failure to protect them.
Suspension. We may suspend or close your account, with or without notice, if you break these Terms or the law, give false information, or act fraudulently or abusively. You may lose access to your history and progress.
4. AI FEATURES AND OUTPUT
The Service uses generative AI from OpenAI. What you submit — text, screenshots, photos, voice answers — is “Input”; what SPARK returns — replies, scores, rewrites, feedback — is “Output”. As between you and us, you own your Input and Output.
You understand and agree that:
- Output is generated automatically. It may be wrong, unsuitable or offensive, and other users may receive similar Output.
- Match Score, profile score and Communication Score are coaching estimates — not facts about you or any other person.
- Output is not psychological, medical, legal or relationship advice and guarantees no match, reply, date or relationship.
- You decide what to send. Review Output before using it. You alone are responsible for messages you send to other people.
You must not use the AI features to:
- create or upload any content that sexualises, exploits or harms minors;
- upload intimate images of anyone, or sexually explicit content;
- harass, threaten, stalk, coerce or manipulate a person, or pressure someone past a clear “no”;
- run romance scams, catfish, impersonate a real person or create fake profiles;
- identify, track or collect information about people shown in your Input;
- produce hateful or discriminatory content (based on race, ethnicity, religion, disability, age, nationality, sexual orientation, gender identity or any similar basis), or content promoting violence, self‑harm or illegal activity;
- bypass safety filters or break OpenAI’s usage policies.
We may filter Input, refuse to generate Output and remove content that breaks these rules.
5. YOUR CONTENT
Licence to us. You grant us a worldwide, non‑exclusive, royalty‑free licence to host, store, process, transmit and display your Input and Output only to operate, secure and improve the Service, as described in our Privacy Policy. The licence ends when you delete the content or your account, except for limited backups and data we must keep by law. We don’t use your conversations, screenshots or photos for marketing.
Your promises. You confirm that you have the right to submit your Input, including other people’s messages, names and photos in it, and that doing so doesn’t violate anyone’s privacy, intellectual property or other rights, or any law. Crop out personal details you don’t need.
Moderation. We don’t routinely review content but may review, restrict or remove it if it seems illegal, harmful or against these Terms. We aren’t responsible for content submitted by users.
Reviews and feedback. If you post a review or rating of SPARK (for example, in the App Store) or send us feedback, we may use, quote and publish it in any media for promotion and product development without payment to you. Contact us at [email protected] or via our contact form at puredating.club if you want us to stop using a review you wrote.
6. SPARK KEYBOARD
The keyboard is optional. It needs “Full Access” only to connect to our servers and send text you choose to process. It doesn’t record keystrokes and isn’t active in password fields. You can disable it in device settings at any time. You’re responsible for following the rules of the apps you use it in.
7. INTELLECTUAL PROPERTY AND LICENCE
The Service and Content — software, design, trainers, scenarios, quizzes, articles, scoring methods, names and logos — belong to us or our licensors. We grant you a limited, personal, non‑exclusive, non‑transferable, revocable licence to install and use the app on devices you own or control, for personal, non‑commercial use under these Terms. You may not copy, modify, distribute, sell or reverse‑engineer any part of the Service except where the law allows.
8. SUBSCRIPTIONS AND PAYMENTS
Plans. Some features are free; full access requires a paid plan. We offer weekly, monthly and 3‑month plans. Price, billing period and payment methods are shown before you pay and may vary by country and offer.
Where you buy. In‑app purchases are processed by Apple under its terms. Our order process for web purchases is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our web orders and handles payment, billing, sales tax, cancellations and refunds for them under its Buyer Terms. After payment you receive a personal code to activate the app.
Free trial. Plans may start with a 3‑day free trial. Unless you cancel at least 24 hours before it ends, it converts into a paid subscription and you are charged. We don’t guarantee a reminder before the trial ends. We may change or limit trial eligibility.
Auto‑renewal. Subscriptions renew for the same period at the end of each term until cancelled. The renewal price won’t exceed the previous regular price (excluding introductory or discount pricing) unless we notified you of a price change. Cancel at least 24 hours before renewal through your App Store account or, for web purchases, through the link in your email or by contacting support.
Refunds. App Store refunds are handled by Apple. Refunds for web purchases are governed by our Money‑Back Policy and are issued by Paddle.com. When Apple requests it, we may share data about your use of purchased content to help it handle a refund or chargeback.
Promotional codes. Promo codes have no cash value, are personal and non‑transferable, and may expire.
Price changes. We may change prices with reasonable notice; the new price applies from your next renewal. If you don’t agree, cancel before then.
Failed payments. If a payment fails and isn’t fixed, we may suspend or end your paid access.
How to cancel. iPhone/iPad: Settings → [your name] → Subscriptions → SPARK → Cancel Subscription. Web purchases: use the cancellation link in your purchase email or contact us at [email protected] or via our contact form at puredating.club.
9. PROHIBITED CONDUCT
In addition to Section 4, you agree not to:
- use the Service for any unlawful, fraudulent or commercial purpose (for example, as a paid “ghost‑writing” service for others) without our written permission;
- access the Service with bots, scripts or scrapers, or extract Content to build a database or competing product;
- decompile, reverse‑engineer or access the source code, or bypass security, usage limits or paywalls;
- share your account or personal code, or make the Service available to multiple users;
- upload malware or overload our infrastructure;
- frame or link to the Service without permission, or damage the reputation of SPARK;
- abuse, threaten or harass our support team — we may close your account if you do.
You also confirm you aren’t located in a country under U.S. government embargo and aren’t on any U.S. list of prohibited or restricted parties.
10. THIRD‑PARTY SERVICES
The Service relies on and may link to third parties, including OpenAI, Apple, Google, payment, analytics and hosting providers, and articles may link to external websites. We don’t control them and aren’t responsible for their content, availability or data practices. Your dealings with third parties — including people you meet through dating apps — are solely between you and them. Use caution when meeting anyone in person.
11. DISCLAIMERS
TO THE EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON‑INFRINGEMENT. WE DON’T WARRANT THAT THE SERVICE WILL MEET YOUR EXPECTATIONS, BE UNINTERRUPTED, SECURE OR ERROR‑FREE, THAT OUTPUT WILL BE ACCURATE OR APPROPRIATE, OR THAT USING SPARK WILL LEAD TO ANY RESULT IN YOUR DATING OR SOCIAL LIFE.
Content and Output are for general coaching and entertainment purposes only. They don’t replace advice from a qualified professional (e.g. a therapist). If you are in a difficult or unsafe situation, contact local emergency services or a qualified specialist. Nothing in these Terms limits consumer rights that can’t be waived under the law of your country.
12. LIMITATION OF LIABILITY AND INDEMNITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, EMPLOYEES, AGENTS AND LICENSORS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL OR RELATIONSHIPS, OR FOR THE CONDUCT OF ANY PERSON YOU COMMUNICATE WITH, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
OUR TOTAL LIABILITY FOR ALL CLAIMS IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR USD 100.
If you’re a California resident, you waive California Civil Code § 1542, which says a general release does not extend to claims a person does not know or suspect exist when agreeing to the release. Some jurisdictions don’t allow some of these limits; where a limit is unenforceable, the rest still apply as far as the law allows. Nothing here limits liability for death or personal injury caused by negligence, or for fraud.
Indemnity. You agree to defend, indemnify and hold harmless us and our affiliates, officers, employees and agents from claims, losses and costs (including reasonable legal fees) arising from your Input, messages you send, your use of the Service, or your breach of these Terms, the law or anyone’s rights. We may control the defence of any such claim; you may not settle it without our written consent.
13. DISPUTE RESOLUTION AND ARBITRATION
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS. IT DOES NOT APPLY TO EEA OR UK RESIDENTS.
Informal resolution first. Before starting any claim, you must send us a written notice to 2B Pavla Li Lane, premises 8, Holosiivskyi District, Kyiv, 03195, Ukraine or [email protected] with your name, contact details, account email, a description of the dispute and the relief you seek, signed by you personally. We’ll both try in good faith to resolve it within 60 days, including at least one video or phone call. Completing this step is a condition for starting arbitration or a small‑claims case.
Binding arbitration. If the dispute isn’t resolved, you and we agree to resolve any dispute relating to the Service or these Terms by final, binding individual arbitration administered by National Arbitration and Mediation (NAM) under its rules, except (i) individual claims in small‑claims court and (ii) intellectual‑property disputes. The Federal Arbitration Act governs this section. Arbitration will be held in English, online or on written submissions unless the arbitrator decides a hearing is needed. Fees follow the provider’s rules; if they would be prohibitive for you, we will cover the necessary part unless your claim is frivolous. Where 10 or more similar claims are coordinated, they may be handled in batches (bellwether cases followed by mediation) under the provider’s mass‑filing rules.
CLASS ACTION AND JURY TRIAL WAIVER: YOU AND WE MAY BRING CLAIMS ONLY ON AN INDIVIDUAL BASIS, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE OR REPRESENTATIVE PROCEEDING, AND BOTH WAIVE THE RIGHT TO A JURY TRIAL.
Governing law. Outside the EEA and UK, these Terms are governed by the laws of Ukraine, without regard to conflict‑of‑law rules. Any court proceedings permitted under this section will be brought in the courts of Kyiv, Ukraine.
Time limit. To the extent permitted by law, any claim must be filed within one year after it arose, or it is permanently barred.
14. OPTING OUT OF ARBITRATION
You can opt out of Section 13 by emailing [email protected] within 30 days after you first use the Service (or after this version takes effect, if you’re an existing user). Include your name, account email and a clear statement that you want to opt out of arbitration. Opting out doesn’t affect the rest of these Terms.
15. EEA, UK AND CALIFORNIA RESIDENTS
EEA and UK. You keep all mandatory consumer protection rights of your country of residence. You may bring proceedings in the courts of your habitual residence, and we will bring any claim against you there. Unless mandatory local law says otherwise, these Terms are governed by the laws of Ukraine. If you buy on our website, you may withdraw within 14 days as described in our Money‑Back Policy; if you asked for the service to start immediately, your refund may be reduced in proportion to the service already provided.
California. Under Cal. Civ. Code § 1789.3, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (800) 952‑5210.
16. GENERAL
If we don’t enforce a right, that isn’t a waiver. If a provision is invalid, it will be modified to the minimum extent needed and the rest stays in force. These Terms, the Privacy Policy and the Money‑Back Policy are the entire agreement about the Service. You may not transfer these Terms; we may transfer them in a merger, acquisition or restructuring. Communications between us are electronic and legally binding; tapping “Continue”, “Start free trial” or similar buttons is your electronic signature. We aren’t liable for delays caused by events beyond our reasonable control (force majeure).
17. NOTICE REGARDING APPLE
If you got SPARK from the Apple App Store or use it on an Apple device:
- These Terms are between you and us only, not Apple. Apple isn’t responsible for the Service or its content.
- Your licence lets you use SPARK on Apple devices you own or control, as permitted by the App Store’s Usage Rules.
- We alone provide maintenance and support; Apple has no obligation to do so.
- If SPARK fails to meet an applicable warranty, you may notify Apple and Apple will refund the purchase price. To the extent permitted by law, Apple has no other warranty obligation.
- We, not Apple, are responsible for claims about product liability, legal or regulatory non‑compliance, consumer protection, and third‑party intellectual‑property infringement.
- You must comply with third‑party terms that apply when using SPARK (for example, your mobile carrier’s terms).
- Apple and its subsidiaries are third‑party beneficiaries of these Terms and may enforce them against you.
- Family Sharing is permitted where your plan supports it.
